Since the implementation of Article 13 in 2021, creating memes has become a bit more challenging. However, it is still possible to create hilarious and viral memes while staying within the legal boundaries. In this article, we will go through some tips and tricks on how to create Article 13 compliant memes in 2023.
What is Article 13?
For those who are not familiar with Article 13, it is a controversial copyright law that was passed by the European Union in 2019. The law requires internet platforms to take more responsibility for copyrighted content that is uploaded by their users. This includes memes, which are often created using copyrighted images or videos.
Why is it challenging to create memes under Article 13?
Under Article 13, internet platforms are required to filter out copyrighted content before it is uploaded. This means that if you create a meme using a copyrighted image or video, it may be flagged and removed by the platform. This has led to concerns that Article 13 could stifle creativity and freedom of expression on the internet.
Tip #1: Use Public Domain Images
One way to avoid copyright issues when creating memes is to use images that are in the public domain. Public domain images are those that are not protected by copyright and can be used for any purpose. There are many websites that offer public domain images, such as Pixabay and Unsplash. Just be sure to check the license agreement to ensure that the image is truly in the public domain.
Tip #2: Create Your Own Images
Another way to avoid copyright issues is to create your own images. This can be done using a variety of tools, such as Canva or Adobe Photoshop. By creating your own images, you can ensure that you have the rights to use them in your memes.
Tip #3: Use Parody or Satire
Under the fair use doctrine, it is possible to use copyrighted material for purposes of parody or satire. This means that if you create a meme that is making fun of or commenting on a copyrighted work, it may be considered legal. However, it is important to note that this is a gray area of the law and can be difficult to navigate.
Response from a copyright lawyer:
“Creating Article 13 compliant memes can be a bit tricky, but it is definitely possible. The key is to be aware of the copyright laws and to use images that you have the rights to use. If you are unsure about the legality of a meme, it is always best to consult with a copyright lawyer.”
Response from a meme creator:
“As a meme creator, I have definitely had to adjust my approach since Article 13 was passed. But I think it is important to respect copyright laws and to find creative ways to make memes that are still funny and relatable. It just takes a bit more effort and creativity.”
Conclusion
In conclusion, creating Article 13 compliant memes in 2023 may require a bit more effort and creativity, but it is still possible to create hilarious and viral memes. By using public domain images, creating your own images, or using parody or satire, you can ensure that your memes don’t run afoul of the law. Just be sure to stay informed about any changes to the copyright laws and to consult with a lawyer if you have any questions.”
